Definitions

The following terms shall be defined as:

  • “Website” or “Service”: the website https://beckerst.de and all its pages.

  • “Publisher”: Fortus, the legal or physical entity responsible for publishing and managing the content of the Website.

  • “User”: the internet user visiting and using the Website’s Services.

These Terms and Conditions of Use (hereinafter referred to as the “T&Cs”) are provided by the Publisher of the Website. The User is encouraged to read these T&Cs carefully, print them, and/or save them on a durable medium. The User acknowledges having read and accepted the T&Cs in full and without reservation.

Article 1 - Application of the T&Cs

The purpose of these T&Cs is to define the conditions under which Users access the Website. The Publisher reserves the right to modify the T&Cs at any time by publishing a new version on the Website. The applicable T&Cs for the User are those in effect on the date of acceptance.

The Website is freely and openly accessible to all Users. Accessing the Website, acquiring a product or service, creating a member account, or browsing the Website implies the User's full and unconditional acceptance of these T&Cs, which the User acknowledges having fully read and understood.

Acceptance may, for example, involve the User ticking a box corresponding to a statement such as "I acknowledge that I have read and accepted all the terms and conditions of the Website". Ticking this box will be considered equivalent to a handwritten signature by the User.

The User acknowledges the evidentiary value of the Publisher's automatic recording systems on this Website and, unless they provide proof to the contrary, agrees not to contest them in case of dispute.

Acceptance of these T&Cs assumes that Users have the legal capacity to do so. If the User is a minor or lacks such legal capacity, they declare having the permission of a guardian, curator, or legal representative.

Article 2 - Legal Notices, Personal Data, and Purpose of the Website

This Website is published by Fortus SARL. Legal information regarding the host and the Publisher of the Website, including contact details and potential registration details, is provided in the Website's legal notices.

Information regarding the collection and processing of personal data (policy and declaration) is provided in the Website's privacy policy.

The purpose of this Website is defined as “an online sales platform.”

Article 3 - Member Area

Registered Users (members) can access the Website by logging in with their credentials (email address provided during registration and password) or potentially through third-party social login buttons. Users are entirely responsible for protecting the passwords they choose. They are encouraged to use complex passwords. In case of forgotten passwords, Users can generate a new one. This password guarantees the confidentiality of information within their “my account” section, and Users must not disclose or share it with third parties. Otherwise, the Website Publisher cannot be held responsible for unauthorized access to a User's account.

Creating a personal account is a necessary prerequisite for any order or contribution from the User on this Website. To do so, the User will be required to provide certain personal information. They agree to provide accurate information.

The purpose of data collection is to create a “member account.” If the data in the member account section is lost due to a technical failure or force majeure, the Website and its Publisher cannot be held liable, as the information holds no evidentiary value but only serves as informational content. The pages related to member accounts can be freely printed by the account holder but do not constitute proof and are intended solely for efficient service management or contributions by the User.

Each User is free to close their account and delete their data on the Website. To do so, they must send an email to Fortus stating their intention to delete their account. After this, it will no longer be possible to recover their data.

The Publisher reserves the exclusive right to delete the account of any User who has violated these T&Cs (for example, but not limited to, if the User has knowingly provided incorrect information during registration or the creation of their personal account) or any account inactive for at least one year. This deletion will not be considered harmful to the excluded User, who cannot claim any compensation for this action. This exclusion does not preclude the possibility of the Publisher initiating judicial proceedings against the User if warranted by the facts.

Article 4 - Access and Availability of the Website

The Publisher makes every effort to ensure the Website is accessible at all times, subject to maintenance operations on the Website or its hosting servers. In case of technical issues or any other reason causing Website inaccessibility, the User cannot claim damages and will not be entitled to compensation.

The Publisher of the Website is bound only by a best-effort obligation and cannot be held liable for any damage resulting from the use of the internet, such as data loss, intrusion, viruses, service interruptions, or other issues.

The User expressly agrees to use the Website at their own risk and under their sole responsibility.

The Website provides the User with information for reference only, which may contain inaccuracies, errors, omissions, or ambiguities. Under no circumstances can Fortus be held liable for:

  • Any direct or indirect damage, particularly concerning profit loss, missed opportunities, client loss, or data loss resulting from the use or inability to use the Website;

  • A malfunction, access unavailability, misuse, incorrect configuration of the User's device, or the use of a less common browser by the User.

Article 5 - Hyperlinks

The Website may include hyperlinks to other websites.

The User acknowledges that the Publisher cannot be held liable for any damages or losses, real or alleged, resulting from or related to the use or reliance on the content, advertisements, products, or services available on these external websites or sources. Similarly, the Publisher of this Website cannot be held liable if the User suffers any damage resulting from visiting one of these sites.

If, despite the Publisher's efforts, a hyperlink on the Website leads to content or an internet source that violates French law, the User agrees to immediately contact the Website's Publication Director (whose contact information is listed in the Website's legal notices) to provide the address of the offending third-party site pages.
