TERMS AND CONDITIONS OF SALE

Definitions

These Terms and Conditions of Sale (hereinafter referred to as "TCS") are proposed by Fortus SARL, with a share capital of €260,000, registered in the Bobigny Trade and Companies Register under number 539758854, whose registered office is located at 28 bis rue du Goulet, 93300 Aubervilliers (hereinafter referred to as "Fortus").

The following terms shall be defined as:

  • "Site": The website https://beckerst.fr and all its pages.

  • "Products" or "Services": All goods (materials) and services available for purchase or subscription on the Site.

  • "Seller": Fortus, a legal or physical person offering its Products or Services on the Site.

  • "Customer": The internet user, individual or professional, making a purchase of Product(s) or Service(s) on the Site.

  • "Consumer", according to the definition of the preliminary article of the French Consumer Code: "Any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, or liberal activity."

The internet user visiting the Site and interested in the Products and Services offered by the Seller is invited to carefully read these TCS, print them, and/or save them on a durable medium before placing an order on the Site.

The Customer acknowledges having read the TCS and accepts them fully and without reservation.

Article 1 - Application of the TCS and Purpose of the Site

The Seller reserves the right to modify the TCS at any time by publishing a new version on the Site. The applicable TCS to the Customer are those in effect on the day of their order on the Site.

Legal information about the Site's host, the collection and processing of personal data, and the Site's terms of use are provided in the terms of use, legal notices, and data charter of this Site.

This Site offers online sales of household appliances, high-tech, interior and exterior furniture, and lighting.

The Site is freely accessible to all Customers. Acquiring a Product or Service implies the Customer's acceptance of all these TCS, who acknowledges having fully understood them. This acceptance may consist, for example, of checking the box corresponding to the statement accepting these TCS, such as "I acknowledge having read and accepted all the terms and conditions of the Site." Checking this box will be deemed equivalent to a handwritten signature by the Customer.

Acceptance of these TCS requires that Customers have the necessary legal capacity. If the Customer is a minor or lacks this legal capacity, they declare having the authorization of a guardian, curator, or legal representative.

The Customer acknowledges the evidential value of the Seller's automated recording systems and, unless they provide evidence to the contrary, they waive the right to contest them in the event of a dispute.

The Publisher provides the Customer, on their Site, with a privacy policy specifying all information related to the use of the Customer's personal data collected by the Publisher and the rights the Customer has regarding this personal data. The privacy policy is part of the TCS. Acceptance of these TCS therefore implies acceptance of the privacy policy.
